Cumulative Determined InfringementsAction
1st timeWritten warning + content removal + internal record retention
2nd time14-day account suspension + removal of all historical infringing content + email mandatory re-reading of this Policy
3rd timeTermination of the account's uploading and posting functions (including reviews, photos and posts; not automatically restored by the passage of time) + removal of all UGC + notification to registered email; other functions of the account (such as random recommendations) may continue to be used
Further infringement, through another account or by any other means, after the uploading and posting functions have been terminatedPermanent account termination + listing on the Company's re-registration ban list (identified by any of email, phone, the random device code generated by the App itself, IP, payment account; for the period under §4.4) + providing relevant information as required by law or by judicial or competent authorities

Transitional rule: the 3rd-time action and the action after it in the table above take effect on November 11, 2026 and apply only where the 3rd determined infringement accrues on or after that date; where the 3rd determined infringement accrued before that date, the actions under Version 3.3 continue to apply (3rd time: 90-day account suspension + posting feature restrictions + removal of all UGC + notification to registered email; 4th time or more: permanent account termination, together with the other actions listed in the last row of the table above).

4.2 Scope of "Determined Infringement":

4.4 Re-Registration Banned List: For persons on the list, the Company may, for a reasonable and necessary period, restrict re-registration on this Platform with the same identifying information; the Company does not restrict the registration of innocent third parties merely because, for example, family members share a device (consistent with §3.4 of the Terms of Service).

  1. Reject the notice and notify the sender;
  2. Record sender information (including IP, email, name, send time, frequency), retained for 5 years;
  3. Place on the abuse notice watch list; subsequent notices shall be reviewed under stricter standards;
  4. For senders with 3 or more abuse records, the Company may refuse to accept all subsequent notices from that sender;
  5. Where necessary, provide evidence per Article 90-11 of the Copyright Act actively or upon the damaged party's request to facilitate prosecution;
  6. The Company reserves the right to claim damages from the notice sender for all costs incurred by the Company in handling false notices (including attorney fees, administrative costs).

10. Platform Reserved Rights and Disclaimers (Important)

10.1 Active Takedown Right

In addition to the notice-and-action mechanism in this Policy, the Company may, based on any of the following reasons, actively take down, hide, demote, or rate-limit any user content; except where otherwise required by law or where judicial or competent-authority confidentiality requirements are involved, the Company shall, within a reasonable period, notify such user and briefly state the grounds, without affecting such user's right to file a complaint under this Policy and to seek remedies in accordance with law:

Active takedown does not constitute admission of infringement, nor affect the Company's intermediary immunity status.

10.2 Confirmation of No Review Obligation

In line with the intent of Articles 90-4 to 90-8 of the Copyright Act, the Company bears no general obligation to pre-screen or actively detect user-uploaded content. The Company's automated detection, sample human review, and quality management are internal quality control measures, not endorsement, recognition, or legal opinion of all unprocessed content. The Company's quality control measures may be adjusted, strengthened, reduced, or suspended as operational needs require; provided, however, that once the Company becomes aware that specific content is unlawful or infringing, it shall still take necessary action in accordance with this Policy and the law.

10.3 Judicial Cooperation

Upon receipt of lawful requests from courts, prosecutors, police, Investigation Bureau, tax authorities, or the Intellectual Property Court, the Company shall, in accordance with law, cooperate to provide user data, IP records, upload times, the random device code generated by the App itself, and other information, which may be done without notice to such user. The Company enjoys civil immunity for disclosures made under such judicial cooperation.

10.4 Refusal to Mediate Disputes

The Company shall not adjudicate, mediate, or arbitrate in any form the substantive copyright disputes between rights holders and uploaders, nor shall it express opinions on whether infringement is established. The parties shall pursue resolution through judicial or arbitration procedures themselves; the Company only cooperates with the notice-and-action mechanism under this Policy.

10.5 Indemnification

If user-uploaded content infringes third-party rights, causing the Company to receive third-party claims, litigation, administrative fines, or reputational damage, that user shall fully compensate the Company's all losses (including attorney fees, litigation costs, settlement amounts, platform cleanup costs), processed per §17 of the Terms of Service.

10.6 Severability

Where any provision of this Policy is held invalid or unenforceable, only that provision shall be invalidated; the remaining provisions remain effective.

10.7 Governing Law and Jurisdiction

This Policy is interpreted in accordance with the laws of the Republic of China (Taiwan). For disputes arising under this Policy, the parties consent to the Taiwan Taipei District Court as the court of first instance with jurisdiction; foreign parties also consent to the jurisdiction stated in the Consent to Service Statement under Article 90-9 of the Copyright Act in their counter-notices.

This Policy Version 3.4, published and effective October 28, 2026, except that the amendment to the 3rd-infringement action in §4.1 takes effect November 11, 2026 (notice is given 14 days before the effective date under §9.2). Changes in Version 3.4: (1) §2.2 now provides that, upon receipt of a qualifying notice, the Company immediately removes the alleged content or disables access to it and notifies the uploading member, and completes its review and records the infringement within 3 working days; where the information in a notice is incomplete, the Company replies requesting supplementation, and the preceding item applies from the time a qualifying notice is received (previously, the Company conducted a preliminary review within 3 working days of receipt and took the content down only if the review passed), so as to meet the requirement of "immediate" removal under Article 90-7 of the Copyright Act; this item is an amendment made to conform to the law and takes effect on the date of publication; (2) the 3rd-time action in §4.1 is changed from "90-day account suspension + posting feature restrictions" to termination of the account's uploading and posting functions (including reviews, photos and posts; not automatically restored by the passage of time), while other functions of the account (such as random recommendations) may continue to be used; the former "4th time or more" row is changed to "further infringement, through another account or by any other means, after the uploading and posting functions have been terminated", which results in permanent account termination and listing on the re-registration ban list, so as to meet the requirement of "terminating all or part of the services" under Article 90-4, Paragraph 1, Subparagraph 2 of the Copyright Act; this item is a material amendment, notice of which is given 14 days before the effective date under §9.2; it takes effect November 11, 2026 and applies only where the 3rd determined infringement accrues on or after that date, while the Version 3.3 actions continue to apply where it accrued before that date (see the transitional rule in §4.1).
Prior Version 3.3, published October 14, 2026 and effective October 28, 2026 (notice is given 14 days before the effective date under §9.2); prior Version 3.2 published and effective September 29, 2026; prior Version 3.1 effective June 6, 2026; prior Version 3.0 effective May 15, 2026, last revised May 4, 2026.
Changes in Version 3.3: (1) the Communication Channel in the header, the Backup Channel in §2.1 and the Mail Delivery Address in §8 now state the Company's registered address (4F., No. 158, Sec. 1, Xinsheng S. Rd., Zhongzheng Dist., Taipei City, Taiwan) directly, so it no longer needs to be requested by email first; (2) in §3.2, a counter-notice is forwarded to the original notice rights holder "immediately" under Article 90-9, Paragraph 3 of the Copyright Act, instead of "within 3 working days"; the basis for restoring taken-down content is corrected from Paragraph 3 to Paragraph 5 of that Article, and the Company "shall" restore it under that Paragraph; (3) in §7, "human review" in the Filtering Mechanism is changed to "where human judgment is required, the Company conducts a further review", and the last paragraph of §7 now states that, for content reports under item 1 of that Section, the Company takes action within 24 hours of receipt (including hiding the content pending review) and, where human judgment is required, the review is, in principle, completed and notice given within 7 days (see Section V of the Community Guidelines and Reporting Standards), and that copyright takedown notices and counter-notices are handled on the timelines in §2.2 and §3.2 of this Policy; (4) the action for a fourth or subsequent infringement in §4.1, and §4.4: instead of "may not re-register within 5 years through any combination of identity", the Company may, for a reasonable and necessary period, restrict re-registration with the same identifying information, and the references to "real-name identity" (which the Company does not collect) and to "affiliates" are deleted, consistent with §3.4 of the Terms of Service; (5) in §4.3, related merchant accounts are limited to those with the same principal or the same business identification number, "same registered address" is deleted, and it is stated that the accounts of innocent third parties are not aggregated merely because family members share a device or businesses operate at the same address; (6) "Service Hours" in Section 8 is replaced with "How to Reach Us": by email, with a reply in principle within 5 working days.Further change in Version 3.3: (7) in the action for a fourth or subsequent infringement in §4.1, "reporting to partner platforms and competent authorities" is replaced with "providing relevant information as required by law or by judicial or competent authorities".
Changes in Version 3.2: (1) a missing word ("take down") in §1.4 of the official Chinese version is corrected; (2) in §2, the location of the allegedly infringing content now uses the Service's actual share-link format (app.swayfoodapp.com), and for restaurant reviews a complete screenshot of the review should be attached; (3) the cross-reference in §2.3 is corrected to the processing timeline in §2.2; (4) the description of the reporting entry in §7 is corrected to the report button or "⋯" menu on posts and reviews; (5) the device fingerprint listed in §4.1 and §10.3 is corrected to the random device code generated by the App itself; (6) translation corrections (including the jurisdiction consent statement in §3.1, the re-registration ban list and aggregated records in §4, business goodwill damage in §5.1, and the block list path in §7). Version 3.2 only corrects descriptions, a missing word and translations to match how the Service actually operates; it does not change how the Service actually handles notices, and therefore takes effect on publication.
